Digital Millennium Copyright Act Policy

Greetings to the ‘Site’. We value the rights of intellectual property of others just as we expect others to respect our rights too. Being an internet service provider, we have the authority to claim immunity from any infringement claims according to the “safe harbor” provisions of the DMCA. To submit a legitimate infringement claim, you must provide us with a notice that contains the following details:

Notice of Infringement – Claim

  1. A physical or electronic signature of the copyright owner (or someone authorized to act on their behalf);
  2. Identification of the copyrighted work alleged to be infringed;
  3. Identification of the infringing material to be removed, and details to help locate it;
  4. Contact information for the complaining party including name, address, email, phone, and fax number;
  5. A statement affirming the belief that the material’s use is unauthorized by the copyright agent; and
  6. A statement confirming the accuracy of the information, and that the complainant has the authority to act on behalf of the copyright owner.

Title 17 USC §512(f) outlines civil penalties against those who misrepresent information in an infringement notification under 17 USC §512(c)(3).

Please be aware that we may disclose the identity and details in any copyright infringement claim we receive with the alleged infringer. By filing a claim, you agree that your identity and claim may be shared with the alleged infringer.

Counter Notification – Restoration of Material

If you have been notified of material takedown due to a copyright infringement claim, you can provide us with a counter notification in an attempt to restore the material. The notification must be in writing to our DMCA Agent and should contain the following elements per 17 USC Section 512(g)(3):

  1. Your physical or electronic signature.
  2. A description of the material taken down and its original location.
  3. A statement, under penalty of perjury, that the material was removed due to mistake or misidentification.
  4. Your name, address, telephone number, and consent for jurisdiction.

Repeat Infringer Policy

We treat copyright infringement seriously. Following the Digital Millennium Copyright Act’s repeat infringer policy, we keep a record of DMCA notices and make efforts to identify any repeat infringers. Violators of our internal repeat infringer policy will face account termination.
